The result of using Alcohol Tester

That's what witnesses said of an NYPD officer accused of driving drunk and mowing down a woman hailing a cab.

 

But as CBS 2 HD found out earlier Tuesday, a blood-alcohol test showed no booze in his system.

 

There was fury in Brooklyn Tuesday night as the mother of Vionique Valnord reacted to Police Officer Andrew Kelly's buy blood- Alcohol Tester results.

 

"Guilty, guilty, guilty, guilty! He's guilty!" Philosia Valnord said.

 

CBS 2 HD has learned the blood sample taken from the officer will be of no use to the prosecution. It came back zero.

 

Kelly successfully delayed being tested for booze for seven hours after accidentally running down and killing Vionique Valnord on Sunday morning in his personal vehicle. He's charged with manslaughter, but the victim's mother said someone is trying to cover.

 

"The cops are for him. He refused to take the test," Philistia Valnord said.

 

NYPD Commissioner Ray Kelly said part of the delay was routine and part was a misunderstanding by a doctor at Kings County Hospital.

 

"The doctor on duty there refuses to administer the blood test because he was under the mistaken impression he had to have the individual's consent to do it, the officer's consent," Commissioner Kelly said.

 

The blood-alcohol test, especially China Wholesale Alcohol Tester, though, isn't the beginning and end of the case. There's additional evidence, including people who smelled alcohol on his breath, and heard his slurred speech. There's video of the men drinking in the bar, and testimony of people who said Officer Kelly had six or seven beers before getting behind the wheel. That's about the amount of alcohol that would burn off over the course of seven hours.
